California's New Cell Phone Law: A Band-Aid for a Stab Wound?

On July 1, 2008, California joined five other states - Connecticut, New Jersey, New York, Utah and Washington by enacting two new laws governing the use of cell phones in vehicles. The first prohibits all drivers from using a hand-held wireless telephone while operating a motor vehicle, but motorists eighteen and over may use a "hands-free" device.1 The second prohibits all drivers under the age of eighteen from using any type of wireless telephone or "hands-free" device while operating a motor vehicle.2 The fine for a first offense is $20, subsequent infractions increase to $50. The new laws allow drivers to use a wireless telephone to make calls to emergency services such as law enforcement, medical provider, or fire department.

Diversity: We See It and We Know It

Elder Abuse - Clear and Convincing

It is the unfortunate truth that elderly residents of skilled nursing facilities are all too often victims of abuse and neglect. Until recently, the plaintiff's bar was reluctant to bring suit on behalf of abused elders because recoverable damages did not justify the costs of litigation. In order to encourage attorneys to take up the cause of abused elderly persons and dependent adults, California amended its Elder Abuse and Dependent Adult Protection Act1 (Elder Abuse Act) in 1991 to allow for the recovery of enhanced remedies.
