Preemption and the Future of Pharmaceutical Litigation

The Supreme Court's upcoming preemption case, Wyeth v. Levine, has got a lot of Plaintiff's attorneys and Pharmaceutical companies buzzing about what this case could mean for the future of pharmaceutical litigation. Although some Plaintiff's attorneys are concerned that the decision in this case could essentially end litigation in this field, this concern may not fully be warranted. A closer look into the Supreme Court's recent decision in Riegel v. Medtronic may provide some insight on what to expect in the decision for Wyeth.

Gay Marriage and California Supreme Court: The Musical

On May 15, 2008, in light of an in-depth analysis of California State Constitutional precedent, the California Supreme Court ruled, that same sex couples must be afforded the right to marry in the State of California. In their decision the court held that, "[i]n light of the fundamental nature of the substantive rights embodied in the right to marry-and their central importance to an individual's opportunity to live a happy, meaningful and satisfying life as a full member of society-the California Constitution properly must be interpreted to guarantee this basic civil right to all couples, without regard to their sexual orientation."

Cracking the Glass Ceiling: The Triumph of Women in Law and Politics

My firm represents the growing trend towards a more gender-balanced legal profession, with six of our eleven attorneys being females. In a field where women were once thought of as too sensitive, emotional and kind, and not as persuasive and convincing as men, their increasing presence in the legal and political arenas are beginning to put those misconceptions to rest, deflating the idea that only men were meant to make, apply and execute the laws.
